Count My FDCPA & FCRA Violations

I had to break my lease on an apartment due to my inconsiderate neighbors upstairs in April of 2007. Before I did, I wrote numerous letters to the managemnt and made several calls begging for help. After a few correspondences back and forth all to no avail, I decidfed to walk away and sent a letter to the apartment management telling them all the reasons I was moving especially when a light fixture almost clipped my 6 year old on the head from the neighbors tromping up and down. I also included the date I was leaving with a return receipt giving them a two week notice.

In Sept of 2007, I find out tht there was a collector trying to recover $3k from me for the apartment complex. I spoke with the collector and told her my story along with the emails I had sent. She told me she was going to investigate it as she thought she would be able to get this written off and get back to me. A week had passed after we spoke and I get a letter in the mail stating that since I refused to cooperate, they were reporting me to the credit bureaus.

I called her back enraged and she said, without a police report, there was nothing I could do and that was it. I never refused to pay, I just felt that the eviction it shows and the amounts were ridiculous since I had tried to work it out and had proof.

The credit report shows the initial date as Jan 2008?

1) Why would it not show up for May since that was the date of deliquency?

2) WOuld I be able to fight to get this creditor removed from my file since they reported the info while in dispute? Isn’t that against the FCRA?

I am so torqued bcause not only did I endure 5 months of their BS, but now I have 7 years of it!!

Deficiency Judgments Are Real

I received a notice of deficiency judgement after the foreclosure of my home in IL. Am I liable to pay this back?

Also I heard about an REM sale or way to buy the property back from a bidder.  The bank still owns the home – in your experience is there anyone out there who would either

a). Give us a loan to purchase the property (I had been out of work but now have the means) or

b). allow us to rent the property from them. 

I have been searching the internet but have not come up with anyone with the answers. Hopefully you can either refer me somewhere or have come across these questions before

Florida Foreclosure Law

I have been hearing alot about the new law that goes into effect in Florida in November regarding not being able to take a fee or deposit up front from a homeowner unless you are a lawyer.  Is this true and is there any way to to be legal without being an attorney. 

Our clients love us.  We work very hard for them and charge much less than an attorney.  I am afraid that if we don’t get the fee before the Mod is complete it is just human nature that we will have to fight to get paid.  As it is we break our fee into  3 payments to give them some breathing room. 

It really kills me that my company has to pay the price for the crooks out there that couldn’t care less about doing the right thing, and actually making a good living helping people.  They would rather do nothing and just be the bums and theives that they are!!!  Thanks again.

Follow My Wisconsin Deficiency

Kristi’s Extortion

Hi Paul!  

Okay… I feel like I have hit a jack pot! So, you are either going to burst my bubble, or … suggest a course of action!

A 1900.00 CC debt keeps popping up on my CR.
My credit limit for that card (Providian)was 500.00. 
I was in my early 20′s when I closed it-  I am 37 now.
the 500.00 was paid with interest at 700.00 (I have my old bank statement).
It is now past the SOL for reporting.
The original creditor does not have me as owing anything on my CR and refuses to talk to me about the account.
They are unable to be verified….

Write letters to the CRA’s? Oh if only it were that simple! Been there, done that…
 
JDB are passing me around like a game of “Hot Potato”.

CollectorA, CollectorB, CollectorC and CollectorD are all on my Credit report for this PAID debt. Only 3 at the same time though.  Lexington Law gets them removed one by one because they can’t verify, but as one comes off, another with a new name for the same PAID debt pops up!

I just knew they were “incahoots”! So on a whim…. and because I have become obbsessed, I decided to check my states business license database. Yep- all current and active.  A foreign License.

Upon doing a search on CEO names rather than business names I found that yes, they all have the same CEO in common, ThisNameCEO.

Finally I can prove to people I am not crazy and this is a game they are playing with me.

That’s well and good- but how do I end this game once and for all! They have 15 other comapny names they can use to put this on my report.

I don’t care about the phone calls- I can make those go away and they are not what’s damaging me. Besides, I have started to wait in anticipation for their calls with ipod on hand because I could use an extra thousand in my pocket!

Please note-  I am not trying to get out of a debt. Someone provides a service or a good they should be paid! Even if you foreclose or get repossessed because you made a commitment/promise to pay. As you can see by my debt amount- I was not, nor do I live above my means. It’s the principal and the fact that they are doing this, using our credit report, as leverage to pad their pockets.

I feel, however, my situation fits the definition of extortion.

How does the game end??

What would YOU do?

By the way-  IF by chance you DO reccommend an attorney- could you also reccommend an attorney’s name?

Battling Tools of Debt Collection

I just found your site last nite been reading it ever since. What brought me to find your site is a letter i recieved from ThisDebtCollector.  Stating that I owe them 320.80.

“Since you have failed to remit payment in full we are now left with theoption of summiting this account into the credit burwaus for listing on your credit report as an unpaid past due debt. This will be kept there for at least seven (7) years. Because this adverse credit rating becomes public record information it may result in future denial of credit. When collection investigations reveal your debt is substantioal enough and your assests (employment, bank,cars,property) show that they have a net worth, we will at that time consider sueing you in order to force collection.”

Ok this debt was origanlly 170.75 to a matco tool distributor (Tool Truck). according to a old credit report i have it states Date opened 01/2005 but date placed for collection [11/2001] Estamated date of removal 01/2008 It is not on my credit reports as of last nite from Equifax, Transunion, or Experian. So from reading your post I gathered they cannot repost it to my credit reports if I understand what I read properly. I have looked at expertlaw.com/library/limitations_by_state but im not sure where a Tool Truck debt falls. I live in Washington State.  Pretty sure they are just triing to scare me.

Any suggestions you have and or pointers would be greatly appeciated.

Nevada Collection Agencies

I went through a foreclosure in Nevada and I had a first and a second mortgage.  When I started receiving collection letters from a collection agency (approx. 10 months after he foreclosure) I sent the collection agency a Validation of Debt Letter. They validated the Note but not proof that they are legally allowed to collect in Nevada.I sent them a second Validation Letter requesting that proof. 45 days have expired since they recieved my second letter(certified mail/w signature) What do I do? They have not provided me with the information I requested and 30 days have expired. Thanks
