I pulled my yearly credit report on Friday and was astonished to see that I had a judgment filed against me from New Century Financial Services Inc (Pressler and Pressler).
I had a charge off a while ago, and it was supposed to fall off my credit report (as it has reached 7 years) this month. It rolled off on all of my reports except for transunion.
To get to my points:
1) I never received any information from New Century Financial Services Inc (NCFS)
2) I do not know how a judgment could have been placed against me, considering I had not received any legal claims towards me regarding any debt.
3) If this is an attempt to collect the any of my past debts, they all reached the statue of limitations a while ago. I have lived a credit free existence for the past 3-4 years
4) NCFS has been sued on numerous occassions for violating consumer’s rights according to FDCPA
5) Pressler and Pressler has been noted as falsely serving their defendants
6) NCFS has gotten many judgments vacated because of lack of proof of ownership of debt.
After much research, I believe that I have been violated due to the FDCPA. I am trying to figure out the next steps in terms of getting this blemish off of my credit report and off of public records. I think I should start w/ a motion to vacate the judgment, but I’m not sure. I live in Manhattan, and we I can’t find a “clerk’s office”…not sure what the equivalent of that here is.
Any help you can provide would be very useful.
