Technical & Cold Creditors

Hello, I work in the lending industry and I have a client that missed two consecutive payments Feb/March of this year. It was a total error due to my client being on chemotherapy medication and it has been explained to the lender but they don’t seem to want to take off the lates. How can they get these two lates removed? They were 1-3 days late each month to get the 2×30. Help..

6 months ago, I made a car payment that was 2 months past due on Saturday. On Thursday the following week, my car was repossessed because their computer system didn’t indicate the payment made over the weekend. I was informed if I had called, the repossession wouldn’t have happened despite the fact that i made a payment at their branch location. I had my car back in 3 hours, now there is a redeemed repossession on my credit. Do I have grounds to ask for that to be removed? Additionally, the account is now listed under closed accounts, but it’s an open account being paid as agreed.

Damaging Debt Collection Inquiries

I am really beside myself.  I have been attempting to repair my credit for almost three years now.  Your website has been so helpful in helping me do this.  Thank you so much. 

My problem is this.  I only have two bad issues remaining on my credit report.  I’m just going to let them go because they will drop off in December 2009 and January 2010 anyway.  At this point its not worth the trouble.  My problem is this.  There is an old Ford Credit debt from over ten year ago I defaulted on.  Apparently they sold the debt to a collection agency recently.  Because of the age of the debt the collection agency cannot report it on my credit reports.  However I find out that this collection agency did a hard pull inquiry in March of this year and again in May of this year.  As you know because they are hard pull inquiries it damages my credit score. 

Is this what I’m going to be faced with the rest of my life from debt collectors?  I’ve noticed that several people complaining to you on this website about old “should have been forgotten” debts coming back to haunt them.  Is this whats going to happen with me?  I need help here.  Please tell me what to do.

Mortgage Company Ignored Bankruptcy

Hello Paul.

I went bankrupt 9 years ago. Once the court approved my payment plan, I kept up with all my payments.

The mortgage company ignored the payment plan and continued to report all the payments as 120+ days late.

I now have perfect credit except for this account. They claim that since my wife didn’t go bankrupt, she was late and since I’m on the laon, I’m also responsible for her late payments.

Can anything be done about this? I’m trying to buy a house and this one thing is killing me.

Rick’s Deletion

Paul,  When negotiating with a Collection Agency, I sometimes ask for a Pay-for-delete letter.  Most everyone tells me that they can’t do this as it is against the law….or the original creditor would have to accomplish this.   From reading your columns, it give me encouragement to think that this is possible.  

Is there a such a law, or are the Credit collection agencies incorrect?   If I could quote them a UCC of law indicating otherwise, I would feel more comfortable to hold-out for such a letter.  I can hold out as long as they can, but I would really like to inmpove my Credit scores.  Any insight?    I enjoy your blog and assortment of topics.

Post Short Sale Cleanup

Hi Paul…I purchased a house in 2006…got behind on a payment and GMAC would not work with me to bring it current….in Aug 2008 I put the house on the market….GMAC sold my note to Midland and Midland sold the house under a quick sale…they have listed it on my credit as paid in full…..however…GMAC has listed on my credit also…as a foreclosure…the house was never foreclosed on although it was in preforeclosure status at one time….how can I get them to delete themselves off my credit report altogether since they sold my note before foreclosure?

Credit Repair Mortgage

Due to being on a repayment plan with my mortgage company, my loan payments increased dramitically.  

I have been paying the extra-high prices for almost a year, but yet the mortgage company (Ocwen) indicated they will not readjust the credit rating until after I have paid them for another year  (as same rate).  Because they have my credit scores rated so low, nobody will refinance me.  

I have lived in my home for almost 28 years, have over $125K in equity, a vietnam vet (no help) and make more than enough to pay for a home 3x this value.  

How can I get the mortgage company to update my credit report so that I can get rid of this company and refi with a reputable firm.
