Mortgage Bounced Check

In July I suffered identity theft with my bank account. My July payment was reversed due to the bank freezing my account.

I then continued paying Aug, Sept,and Oct. I also applied a partial payment for July but my mortgage company won’t apply it until its a full pament.

All this time they continue to report 30-60 days late and add late fees, and default notices.

Is this legal or ethical?

Preauthorized Draft – Not Exactly!

I had made payment arrangements with a collection agency. The debt is mine and I want to pay it off now that I can. It is a recent collection.

I gave the collection agency(pro collect) an electronic check to draft on the end of the month. They ran it through yesterday. It’s my understanding they are in direct violation of the FDCPA. They screwed my account up really bad.

My question is how do I make them pay for the other returned items caused by their unautorized draft. Their has to be some legal recourse. I was trying to do the right thing and got burned.

NSF Checks

Love your sight. I have learned more here in a week than I could ever possibly use. It’s nice to sit down with a mortgage broker and know more about credit repair and collections than they do. Knowledge is power.

Anyway, my question is can my name be listed on a collection from a bad check I did not write but it was a joint account?

I have been checking my credit report and disputing errors with good results so far. 2 deletions and one update in two weeks. I ran my report this morning and a new collection showed up. I called the original creditor which is a local hospital and they had no record of me in the system ever, period. I called the collection agency and they told me since it was a joint account it was listed on my report. I asked them if they had any documents with my signature and they said no. They also told me to contact the credit bureaus and dispute. I told them I am dispuiting with you and want proof that the debt is mine. Do I have a valid argument here?
