Dismissed Lawsuit

If a lawsuit was filed on behalf of a credit card company, and the case was dismissed without prejudice, and never re-filed by the Plaintiff, can another collection agency attempt to collect on the same debt?

Hi Missy,

Yes, everything else equal, another collection agency can attempt to collect on that debt.

A dismissal without prejudice generally permits the plaintiff to bring another suit on the same claim while a dismissal with prejudice bars the plaintiff from bringing another action on the same claim.

Thanks for the questions and hope this helps.
