FCRA 30 Day Dispute Reinvestigations

Hi Paul.

First I would like to say thank you for all your help with this blog. It has really come in handy.

My question is when does the 30 day clock start on any request for investigation from a CRA?

I sent a dispute letter CMRRR. It was received about a week ago, but there is no information from the CRA that there is a dispute yet.

Does the 30 day time limit start once they received the dispute request or does it start once they enter the information?

Hello Tim,

It starts once they receive the notice of dispute.  Specifically, the FCRA § 1681i(a)(1)(A) reads:

“Subject to subsection (f) of this section, if the completeness or accuracy of any item of information contained in a consumer’s file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, the agency shall, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph (5), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller.” (emphasis added)
