Florida Foreclosure Procedures
Hello Paul,
Thank you for your time and dedication to informing people of their rights in the unfair world of credit and mortgages.
I have a couple of questions, once a notice to foreclose is served in Florida and a response is sent back to the lender from the homeowner challenging certain items on the foreclosure lawsuit, what is the next step and what is the process from the lender?
Do they have to address each dispute in court? and if so, what is the time frame?

Hello Robert,
The ‘response’ isn’t sent ‘to the lender’; the response needs to be sent to the court and a copy to the lender/plaintiff’s attorney. That response needs to be filed within twenty-days of in-hand service or the defendant waives away vital defenses.
What about discovery? Interrogatories, requests for admissions, production of documents, perhaps even depositions? I hope you’re not missing the boat.
