Bungled Foreclosure

Paul, I was recently served foreclosure papers stating that a lawsuit has been filed against me. The first page references me as the defendant with my address, but thats it!!

The rest of the documents pertain to someone else, they actually served me with someone elses documents including copies of original loan documents.

I don’t know what to do. I’ve been reading your website and it’s by far the most knowledgeable of all the ones I’ve visited so I was hoping for a little advice, thanks!

Hello Shaun,

That sounds like an easy motion to dismiss with attorney fees paid by the plaintiff in this action.  I see a loan modification in your future with capitalized delinquent payments and a rate reduction down to 2% – well, either that or sanctions for the foreclosure mill lawyer.  My guess is that they’ll be your best friend moving forward.
