May I File BK Individually?

If i have credit card debt in my name only and my wife has a house in her name only can they come after whats in her name if we are legally married and if i want to file bankruptcy will they not let becasue she owns a home.

Hi Ira,

Yes, a married person may file for bankruptcy individually.  At your “341 meeting” (also know as the “meeting of the creditors”, typically required about 20 to 40 days post bk petition) it is doubtful that you would be asked any questions as to why you are filing alone.
