Ronnie’s Rescission

Paul,

how do you go about finding out to see if you had a Tila violation to see if you qualify for the 3 year rescission time frame ?

I think I maybe able to do this on my house.

Hello Ronnie,

You need a copy of your final TIL Disclosure, HUD1, note (and adjustable rate rider if applicable), and rescission notices.

Then, you need to find a material violation that would trigger the extension of your rescission rights.

Once a homeowner has found such a violation and has a means of tendering the remaining balance owed, a rescission notice is sent to the lender and at that point the fun begins.

Thanks for the questions and don’t cut yourself with the TILA.
